关于格鲁吉亚辅助生殖相关政策调整 2020年9月1日

尊敬的佐佑客户朋友：

近期，格鲁吉亚司法部修改了辅助生殖相关政策要求，具体内容为将适用对象由原“已婚夫妻 或 情侣（男女）”调整为“1. 已婚夫妻，结婚一年以上 或 2. 情侣（男女）， 同居一年以上”，新规自2020年9月1日起施行。项目新增要求为客户提供已婚或同居一年及以上相关证明文件，但截至9月9日，尚未明确具体的执行细则，如所认可的文件类型及内容、适用项目的时间范围，是否影响外国人及已经进行中的项目等。与此同时，受疫情影响暂时中止的外国人入境项目的确切重启时间也仍然尚未明确。因此，在上述细节明确之前，希望大家耐心等待，稍安勿躁，不轻信谣言，有新的进展我们会第一时间告诉大家~

Adopted by the Minister of Justice of Georgia

About making amendments to the Order N18 dated 31.01.2012 adopted by the Minister of Justice of Georgia “about approving the regulation for registering civil acts”

In accordance with the par. 4 of Article 20 of Organic Law of Georgia about “Normative Acts,” I order the following:

Article 1. On the basis of Order N18 dated 31.01.2012 adopted by the Minister of Justice of Georgia „about approving the regulations for registering civil acts” (Georgian legal herald www.matsne.gov.ge, date 31.01.2012, registration code 040030000.22.027.016240) of Article 19:

1.     Paragraph 1, sub-par. “a” shall be established in following edition:    

a)     The notice confirming the extra-corporeal fertilization (enclosure N2), which is issued by medical institution as soon as embryo has been implanted, but no later than following working day. The mentioned notice should be signed/stamped with qualified electronic stamp/qualified electronic signature in accordance with Georgian law “about trustworthy electronic service and electronic document;”

2.     Following the par. 1 should be added the following par. 1¹ and 1² with following content:

1¹ . The contracting party of the contract determined subject to sub-par. “b” of par. 1 of this article may be the couple (man and woman) whose aim is to bring the child born through extra corporeal fertilization up and if they:

a)     Are married and this marriage period is not less than 1 year;

b)     Are living together as life partners, and this period is not less than 1 year.

1² .  The fact of being in factual living partnership of man and a woman should be confirmed by the notary with relevant documents (information-address card, which confirms the fact of registration at one address, extract from public registry, which evidences the fact of co-ownership regarding the property targeted from common consummation, document evidencing the religious marriage or other).”

3.     The par. 2 shall be edited in following way:

2. In case if the documents submitted for Civil Acts Registry evidence that after the embryo was created it was cryo-preserved (frozen) and the period from embryo creation till its implantation is not more than 10 years, the contract foreseen under sub-par “b” of par. 1 of this Article should be signed before the embryo is implanted. In Such case the Agency should be submitted the notice drawn upon and executed before cryopreservation (freezing), where the identity of couple should be indicated who will be mentioned in the Birth Certificate of child as parents.”

Article 2.

1.     Before this order enters into force on the basis of application submitted about registering the birth fact of child through extracorporeal delivery the registration will be carried out in accordance with the regulation applicable before this order enters into force.

2.     The par. 1 of Article 1 of this Order is applied to the notice issued after September 15^th, 2020.

3.     The par. 2 and 3 of Article 1 of this Order are applied to the contract signed after September 1^st, 2020.

Article 3.

1.     This order, except the first paragraph of Article 1 enters into force since 01.09.2020;

2.     The first paragraph of Article 1 of this order enters into force since 15.09.2020
